Terms and Conditions
Effective October 28, 2026 · Last updated October 28, 2026
Please read these terms before purchasing or using Little Yardstead.
1. Definitions
Little Yardstead ("Company," "we," "us," or "our") provides online garden planning software. Our website, garden planning tools, and related features are collectively the "Service." These Terms and Conditions ("Terms") govern your access to and use of the Service.
By creating an account, purchasing access, or using the Service, you agree to these Terms.
2. Eligibility
You must be at least 18 years old, or have permission from a parent or legal guardian, to create an account and use the Service. You agree to provide accurate registration information and keep it reasonably current. Do not use the Service if you do not agree to these Terms.
3. Accounts and Security
You are responsible for keeping your account credentials confidential and for activity through your account. Notify us promptly if you discover unauthorized access.
We may suspend or terminate accounts that violate these Terms or threaten the security or operation of the Service. Responsibility for unauthorized access is subject to applicable law.
4. Acceptable Use
Use Little Yardstead only for lawful purposes. You may not:
- Access other accounts or systems without authorization.
- Interfere with the security, operation, or availability of the Service.
- Scrape or reproduce substantial portions of the Service using automated tools without permission.
- Copy, redistribute, resell, or commercially exploit the software without authorization.
- Upload malicious code or use the Service for fraudulent or unlawful activities.
5. Description of the Service
Little Yardstead helps people plan home gardens, including backyards, raised beds, and container gardens. Tools may include garden layouts, plant spacing and placement suggestions, planting timelines, succession planting plans, and related features.
We may add, change, or discontinue features over time and do not guarantee any particular feature will remain available indefinitely.
6. Gardening Information and Disclaimers
The Service provides general gardening information and planning suggestions, not professional agricultural or horticultural advice. Results depend on weather, climate, soil, sunlight, water, pests, plant varieties, and your own practices.
We do not guarantee germination, plant survival, crop yields, accurate planting dates for every situation, pest or disease prevention, grocery savings, or increased food independence. Evaluate recommendations against your local conditions.
7. Payments and Access
The standard price is $40 USD as a one-time payment, unless a different price is clearly displayed at checkout. No recurring subscription charges apply to the standard purchase.
Your purchase grants access for as long as Little Yardstead continues to operate and make the hosted Service available, subject to these Terms. It is not a lifetime access guarantee and does not guarantee indefinite operation, hosting, maintenance, or development.
While the hosted Service is available, your purchase includes occasional updates to the existing planning tools. New products or services beyond those tools may have a separate price.
Payments are processed by third-party payment providers. We do not directly store full payment card details. Applicable taxes, if any, will be disclosed during checkout.
8. Refunds and Final Sales
All sales are final. Little Yardstead does not offer refunds, except where required by applicable law or where the Company chooses to make an exception.
Completed payments are non-refundable regardless of whether you use the Service, how often you use it, or whether you stop using it. The Company may, in its sole discretion, grant a partial or full refund on a case-by-case basis. An exception does not create an obligation to offer refunds in other cases.
Nothing here limits refund rights or consumer protections that cannot legally be waived.
9. User Data
You retain ownership of the garden dimensions, plant selections, schedules, notes, and other information you provide. You permit us to store, process, and use that information as reasonably necessary to operate and improve the Service.
We take reasonable measures to protect data but cannot guarantee absolute security or freedom from data loss. Keep copies of information important to you.
10. Privacy
Our Privacy Policy explains how we collect, use, store, and protect personal information. Contact us using the information provided on our website with privacy questions.
11. Intellectual Property
Little Yardstead and its licensors own the Service, including its software, original graphics, design, and documentation. Your purchase provides a limited, non-exclusive, non-transferable license to use the software for your personal gardening activities; it does not transfer ownership.
You may use, print, or share your generated garden plans for your own gardening purposes, but may not reproduce or distribute the underlying software or proprietary content as a competing product.
12. Availability and Maintenance
We aim to provide reliable access but cannot promise uninterrupted, error-free, or completely secure service. Maintenance, technical failures, hosting issues, security incidents, or other circumstances may cause interruptions. Remedies required by law remain available.
13. Changes to or Discontinuation of the Service
Little Yardstead is a hosted service that may change over time. We may update, replace, suspend, or discontinue features or the Service itself.
Purchased access lasts only while the hosted Service continues to operate and is made available by Little Yardstead, subject to these Terms. A one-time payment does not guarantee lifetime access, perpetual hosting, ongoing maintenance, or future development.
If we permanently discontinue the Service, we will make reasonable efforts to give advance notice when practical. Discontinuation does not automatically entitle users to a refund; the Company may make exceptions at its discretion, and rights required by applicable law remain unaffected.
14. Account Suspension and Termination
We may suspend or terminate accounts for material violations, unlawful activity, or threats to the Service. You may request account and personal-data deletion, subject to applicable retention requirements. Deletion may permanently remove saved plans and purchased access, and does not automatically entitle you to a refund except as required by law.
15. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without express or implied warranties. We do not guarantee accuracy, reliability, fitness for a particular gardening purpose, security, or uninterrupted operation. Mandatory consumer protections remain unaffected.
16. Limitation of Liability
To the fullest extent permitted by law, the Company and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, unsuccessful harvests, crop losses, lost supplies, interruption, or data loss.
To the fullest extent permitted by law, our total liability for claims arising from the Service will not exceed the amount you paid for access in the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot legally be limited.
17. Indemnification
To the extent permitted by law, you agree to indemnify the Company and its operators against third-party claims and reasonable expenses arising from your unlawful use of the Service or material violation of these Terms, excluding claims caused by our own unlawful conduct.
18. Third-Party Services
We may rely on third parties for hosting, payment processing, authentication, analytics, and other functionality. Their own terms and privacy policies may apply. Links to outside resources do not imply endorsement.
19. Modifications to These Terms
We may revise these Terms as the Service or applicable laws change. For material changes, we will make reasonable efforts to notify users through the website, email, or another appropriate method. Updated Terms take effect on their stated date. Continued use after that date constitutes acceptance to the extent permitted by law.
20. Governing Law
These Terms are governed by the laws of Oklahoma, United States, without regard to conflict-of-law principles, except where mandatory consumer laws provide otherwise. Disputes are subject to courts with proper jurisdiction.
21. Severability
If a provision is unenforceable, the remaining provisions continue in effect to the extent permitted by law.
